Roles for Social Change Association-ADWAR in partnership with Marah Radio conducted the seventh episode of the program “My Right” that’s presented by Samar Addibs within the project “Protecting Women’s Legal Rights” under its social program strategies that aims to help women break the barrier of having an access to family courts, as well as protecting their legal rights and reducing gender-based violence.

This episode specified to raise marginalized local communities’ awareness in Hebron Governorate regarding custody and the right of choosing life partner, and shed the light on family courts services and measures and make such information available for community in general.
The interviewer Samar Addibs started the meeting by talking about the project and its goals indicating that it comes within the project Protecting Women’s Legal Rights and providing them with legal information regarding custody and right of choosing life partner, as well as making them know who’s a woman guardian whose consent is a must in marriage contract, and what is the general rule followed in law to prove marriage.

In the beginning of the meeting, the family court judge Dr. Abdullah Asaily talked about custody definition in specific indicating that custody includes many acts related to ward, which means “An authority guardian has on ward giving her guardian the right of marrying her to someone, discipline, education, taking care of him/her as long as they are under custody.

More accurately, custody is a legal right that entitles its holder of being involved in contracts and acts regarding custody that scholars consider as a must in marriage contract pointing out that Hanifa school considers it as a must that marriage contract can’t be done without having it.

Within the meeting Dr. Asaily pointed to whom custody right refers to conduct marriage contract. He said that they might be either of five; father, son, brother, uncle, then guardian.

Concerning woman choice of her partner, Dr. Asaily said that Islam protects women’s rights including their right of choosing life partners, so parents are not allowed to force their daughters marry someone they don’t want to. Parents role regarding marriage is providing guidance and counselling while sons and daughters who decide and choose life partners. He thinks that forcing women to marry someone is a kind of backwardness that Islam fights and rejects. He also indicated that Islam is a religion of mercy, justice and equality that its principles make men and women equal.

The legal advisor Alaa Maraqa praised Dr. Asaily talks regarding women right to choose life partner to reduce divorce cases in Palestinian society indicating that general rules in … that manage and organize marriage as well as ways guardians follow to choose right life partner of wards. Then Alaa Maraqa discussed measures must be legally followed while signing marriage contract in the case of absence of guardian.
